This Privacy Policy (“Policy”) describes EnduraFlood Systems LLC (“EnduraFlood,” “our,” “we,” or “us”) practices with respect to personal information collected in connection with EnduraFlood’s website located at www.enduraflood.com (the “Website”), which allows users to purchase EnduraFlood products.
 

This Policy applies to all persons who access or use the Website. If you do not agree to the practices described in this Policy, do not access or use the Website.  

 

BY ACCESSING THE WEBSITE YOU HEREBY CONSENT TO THE COLLECTION, USE, DISCLOSURE, AND RETENTION OF INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY, NOW AND AS IT MAY BE AMENDED BY ENDURAFLOOD.

We collect personal information using automated technologies.

Personal information is also collected through automated technologies and shared with us when you visit our Website, open emails from us, or click on one of our advertisements.

Other than as described in this Policy, in general personal information is not shared with third parties for third party commercial purposes, other than to our affiliates and business partners.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address: cs@enduraflood.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.


CALIFORNIA USER RIGHTS

 
Your Right to Know and Delete 
 
You have the right to request that we disclose certain information to you about our collection and use of your personal data over the past 12 months. Once we receive and validate your request, we will include a list of your personal data that may have been disclosed and the categories of third parties the information may have been disclosed to.  
 
You may request that we delete any of your personal data that we collected from you and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request. We may deny your deletion request if retaining the information is proper and necessary or if an exception allowing us to retain the information applies. 
 
If your request is approved, we will delete or deidentify the relevant information and will direct our service providers to take similar action.
 
Exercising Your Rights to Know, Delete or Correct
 
To exercise your rights to know or delete described above, please submit a request by emailing us at cs@enduraflood.com. Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal data. You may only submit a request to know twice within a 12-month period. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt, unless we require an extension. If we reasonably require an extension we will inform you of the reason and extension period.
 
Non-Discrimination
 
We will not discriminate against you for exercising any of your CCPA/CPRA rights. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
 
California’s Shine the Light Law
 
California Civil Code Section 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of the information you provide through the Website to third parties for their direct marketing purposes. We do not sell personal information, and in the preceding twelve (12) months, we have not sold personal information. Please note that some US state statutes may define a “sale” to include sharing of personal information with third-parties for valuable consideration, and arrangements with online advertising networks and analytics companies may potentially be considered sales under these definitions.
 

CHILDREN’S PRIVACY NOTICE

 

The Website is not directed or intended towards, nor do we knowingly collect or retain any personal information about, any individual under 13 years of age.  If you are under 13 years of age, do not use or provide any information on the Website or make any purchases through the Website. To the extent permitted by applicable laws, we will securely delete such information from our systems upon being requested to do so by a parent or legal guardian.  To the extent permitted by law, we may, however, retain personal information about an individual that is less than 13 years of age where: (i) such individual has purchased a product through the Website and cancels such purchase and whereby we must retrieve the underlying product sold to such individual; (ii) such personal information is relevant to litigation or potential litigation; (iii) such individual has undertaken any wrongful conduct or conduct that is otherwise actionable in regards to the exercise by EnduraFlood or its affiliates of any remedy available to them; and/or (iv) such retention is reasonable and otherwise permitted under applicable laws.
